Privacy Policy
1. Data Controller. VertexHorizont, located at Calle Isla de Sálvora 9 Derecha, Piso 1 B, La Estación, Collado Villalba, Madrid, Spain, is the data controller responsible for the processing of your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR") and the Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).
2. Data We Collect. When you interact with VertexHorizont — through our contact forms, service inquiries, or cookie-based analytics — we may collect the following categories of personal data:
- Identity data: full name, professional title or company affiliation.
- Contact data: email address, telephone number.
- Technical data: IP address, browser type and version, operating system, device type, referring URLs, and page interaction timestamps.
- Communication data: the content of any messages, project briefs, or inquiries you transmit through our channels.
3. Purpose of Processing. Your personal data is processed exclusively for the following purposes:
- To respond to your inquiries and deliver the digital services you request from VertexHorizont.
- To maintain contractual records necessary for service delivery, invoicing, and project management.
- To comply with legal obligations under Spanish and EU tax, accounting, and data retention law.
- To improve the security and performance of our web platform through anonymized analytics.
4. Legal Basis for Processing. We process your data under the following legal bases as defined in Article 6(1) GDPR:
- Consent (Art. 6(1)(a)): when you voluntarily submit forms or accept non-essential cookies.
- Contractual necessity (Art. 6(1)(b)): when processing is required to fulfill a service agreement with VertexHorizont.
- Legal obligation (Art. 6(1)(c)): when retention is mandated by applicable Spanish or EU law.
- Legitimate interest (Art. 6(1)(f)): for security monitoring, fraud prevention, and platform integrity.
5. Data Retention. VertexHorizont retains your personal data only for as long as necessary to fulfill the purposes for which it was collected. Contact inquiry data is retained for a maximum of 24 months after the last interaction. Contractual and invoicing data is retained for the legally mandated period of 6 years under Spanish commercial law. Technical analytics data is anonymized after 12 months.
6. Data Sharing. VertexHorizont does not sell, rent, or trade your personal data. We may share your data with the following categories of processors solely to fulfill service delivery obligations:
- Hosting and cloud infrastructure providers operating within the European Economic Area (EEA).
- Email and communication service providers bound by Data Processing Agreements (DPAs).
- Payment processing intermediaries (e.g., Stripe) for transaction facilitation, operating under their own GDPR-compliant privacy frameworks.
7. International Transfers. VertexHorizont does not transfer personal data outside the EEA. Should any future transfer become necessary, we will ensure appropriate safeguards under Article 46 GDPR, including Standard Contractual Clauses (SCCs) approved by the European Commission.
8. Your Rights. Under the GDPR and LOPDGDD, you have the following rights regarding your personal data:
- Right of access (Art. 15): request a copy of all personal data we hold about you.
- Right to rectification (Art. 16): request correction of inaccurate or incomplete data.
- Right to erasure (Art. 17): request deletion of your data where no legal retention obligation applies.
- Right to restriction (Art. 18): request limitation of processing in specific circumstances.
- Right to data portability (Art. 20): receive your data in a structured, machine-readable format.
- Right to object (Art. 21): object to processing based on legitimate interest at any time.
- Right to withdraw consent (Art. 7(3)): withdraw previously given consent at any time without affecting prior lawful processing.

Refund Policy
1. Scope. This Refund Policy applies to all digital services provided by VertexHorizont, located at Calle Isla de Sálvora 9 Derecha, Piso 1 B, La Estación, Collado Villalba, Madrid, Spain. It governs refunds for web development, progressive web app engineering, consulting, and all other services offered through our platform.
2. Milestone-Based Delivery. VertexHorizont operates on a milestone-based project delivery model. Each project is divided into clearly defined phases (Discovery, Architecture, Development, Testing, Deployment). Payment milestones are agreed upon in writing before project initiation. Refunds are evaluated relative to the milestone at which termination occurs.
3. Refund Eligibility. You are eligible for a refund under the following conditions:
- Pre-Discovery Cancellation: If you cancel before any work has commenced, you are entitled to a full refund of any advance payment within 14 business days.
- Partial Milestone Completion: If a project is terminated mid-milestone, VertexHorizont will refund the proportional share of the milestone payment corresponding to undelivered work, assessed in good faith.
- Material Defect: If the delivered work materially deviates from the agreed project specification and VertexHorizont is unable to remediate within a reasonable timeframe, you are entitled to a refund of the affected milestone payment.
4. Non-Refundable Items. The following are not eligible for refund:
- Work that has been completed and accepted in writing at the relevant milestone checkpoint.
- Third-party costs incurred on your behalf (domain registrations, hosting fees, licensed assets) which are passed through at cost.
- Consulting sessions that have already been delivered.
5. Requesting a Refund. To request a refund, send a written notice to [email protected] including your project reference number, a description of the reason for the refund request, and any supporting documentation. VertexHorizont will acknowledge receipt within 3 business days and provide a determination within 14 business days.
6. Dispute Resolution. If you disagree with a refund determination, you may escalate the matter through mediation under the rules of the Madrid Chamber of Commerce. Nothing in this policy restricts your statutory rights under Spanish consumer protection law or the EU Consumer Rights Directive (2011/83/EU).
Terms of Service
1. Agreement to Terms. By accessing the website and services of VertexHorizont, located at Calle Isla de Sálvora 9 Derecha, Piso 1 B, La Estación, Collado Villalba, Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services or access our platform.
2. Service Description. VertexHorizont provides digital studio services including but not limited to: progressive web app engineering, mobile-first web development, immersive landing page creation, performance optimization, e-commerce system development, offline-first data synchronization, push notification integration, and app store deployment services. All services are delivered as described in individual project proposals and Statements of Work (SOWs).
3. Project Engagement. Every project engagement begins with a Discovery phase in which VertexHorizont and the client jointly define the project scope, deliverables, timeline, and payment milestones. These terms are documented in a written SOW signed by both parties. The SOW constitutes a binding agreement supplementary to these Terms of Service.
4. Payment Terms. Payments are structured according to the milestone schedule defined in the applicable SOW. VertexHorizont issues invoices at each milestone checkpoint. Payment is due within 14 calendar days of invoice date. Late payments accrue interest at a rate of 0.05% per day on the outstanding balance, compounded monthly, up to the maximum rate permitted under Spanish law.
5. Intellectual Property. Upon full payment of all milestone invoices, VertexHorizont assigns to the client full ownership of all deliverables produced under the project SOW, including source code, design assets, documentation, and creative content. VertexHorizont retains the right to display anonymized case studies of completed work in its portfolio, unless the client explicitly objects in writing.
6. Confidentiality. Both VertexHorizont and the client agree to maintain the confidentiality of all proprietary information exchanged during the course of a project engagement. This obligation survives termination of the agreement for a period of 24 months. Confidential information shall not be disclosed to third parties without prior written consent, except as required by law.
7. Limitation of Liability. VertexHorizont's total aggregate liability under any project engagement shall not exceed the total fees paid by the client under the applicable SOW. VertexHorizont shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
8. Force Majeure. Neither party shall be liable for failure or delay in performance caused by circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, governmental actions, cyberattacks, internet infrastructure failures, or acts of third parties. The affected party shall notify the other party promptly and use reasonable efforts to mitigate the impact.
9. Termination. Either party may terminate a project engagement with 14 days' written notice. In the event of termination, the client is obligated to pay for all work completed and accepted up to the date of termination, in accordance with the refund provisions set out in the Refund Policy. VertexHorizont shall deliver all completed work product within 10 business days of termination.
10. Governing Law and Jurisdiction. These Terms of Service are governed by the laws of the Kingdom of Spain and applicable EU regulations. Any disputes arising from or related to these terms shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain, without prejudice to the consumer's right to bring proceedings in their place of residence under Article 18(2) of Regulation (EU) No 1259/2012.
11. Amendments. VertexHorizont reserves the right to amend these Terms of Service at any time. Material changes will be communicated via email to active clients at least 30 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the amended terms.
